Auction Terms and Conditions for North West Asset Services (NWAS)

This is a legal agreement between you, the buyers/seller and NWAS.  

Registration: All information provided by you, the bidder during the registration process must be current, complete and accurate to the best of your knowledge.  To bid you must be a minimum of 18 years old.  NWAS at its sole discretion may deny registration to any person or entity. 

NWAS holds its auctions with online bidding.  Bidding follows rising increments as the value increases.  If a bid is made in the last three (3) minutes of the auction then bidding will be extended (1 to 3) minutes. NWAS strongly urges bidders to use automatic bidding.  

The Bidder acknowledges that placing a bid is a binding contract between you and the owner/seller. Bids may not be retracted. If you win the bid, you will be obligated to buy the product at the said price as indicated by your bid.
NWAS uses a batch charge system to charge all bidders after the auction. The batch charge uses the "default card" on profiles to pay for any items won during auction. If you would like to be removed from the batch charge system contact a NWAS employee.

Automatic bidding: The Bidder has the ability to place a maximum bid on items of interest. At that time your bid will be placed just above the current bid following bid increments. Your bid will not be increased unless another bid is placed. Your bid will only go as high as you have allowed. If someone prior to you has placed a maximum bid prior to yours, their bid will be accepted. 

NWAS, employees or service providers take no responsibility for the result of connection or web service delays and or connection failure. NWAS may at its discretion close or extend the auction or lot. Please note that posted closing is an estimate only.  

Items and lots are sold "as is, where is, with all faults".  Bidder acknowledges that all items and lots were made available for inspection prior to the auction at a scheduled preview.  By these terms, NWAS and Owner/Seller strongly encouraged Bidder to carefully inspect each item or lot to determine the nature, functionality, quality, condition, quantity, and/or size of the item or lot.  We do not test all items nor do we guarantee completeness or functionality.  Use the catalog as a guide only. 

Sales Tax: Oregon currently does not have a sales tax. If your state has one and you ask us to deliver the items you purchased online we will charge a sales tax for your state.  

Buyer Premium:  Unless a specific auction states otherwise, a 15% buyer's premium will be charged on all items and lots.  Every bidder pays the same buyer premium and should bid accordingly.  For example, if you bid $100.00 on an item and are successful you will be charged $115.00 at check out for that item. 

If NWAS is unable to deliver sold items to the buyer our responsibility will be to refund the amount paid to the buyer. If the title is not available within 10 working days for a titled vehicle, the buyer may have their bid refunded.  

Invoices are sent out via email by NWAS within 12 hours of the close of the auction.  You are expected to pay with card, cash or wire in the exact amount on site within 48 hours. If you pay by wire you will be charged an additional $30.00 for the wire acceptance fee.   We do not accept checks. 

Suspension/Permanent Ban: A Bidder will be suspended or permanently banned from NWAS for failure to pay invoices, and remove purchases all in the time allowed.  For copying photos, text, or code from our site for commercial purposes.  Endangering or threatening NWAS or others.  Not following directions during release or removing property you have not paid for or were not awarded. 

Removal of sold property must be during posted dates and times.  We are not a storage or moving company.  If you leave an item, it may be forfeited or a charge of $10.00 per day per item placed.  After ten (10) days items are considered abandoned and may be resold or disposed of.
